Tenant Evictions

Rental payments are due on the first of each month. After waiting the grace period and postal delays, if rent is still unpaid RE/Sys will serve a "5 Day Pay or Quit Notice" (eviction notice) by posting it on the property and mailing it to the tenant. This starts the eviction process. Tenants can choose to (1) pay the rent due, (2) quit the property (move out) or (3) contest the eviction in court. If payment is received the process is discontinued. If payment remains unpaid then RE/Sys will file an application for a Summary Eviction and ultimately the tenant will be locked out from the property. From start to finish, the eviction can take place in about 2 weeks. Clark County has a very landlord-friendly judicial system for evictions, however, court processing times are getting longer due to personel shortages.
Problems begin to arise when the tenant contests the eviction. A court date is then set, usually within one week and all parties appear before the Justice in Justice Court. It is at that time when tenants usually will expound on their lack of funds or the delay in a repair that incited their withholding of the rent. These reasons are insufficient and the judge usually orders the eviction to continue.
Once the eviction is ordered, a 24 hour Notice is posted by the Constable to inform the tenant that he will be removed within that time. Shortly thereafter, the Constable returns and requests all occupants out of the property, seals the door locked and the locks are re-keyed by the locksmith. An eviction is considered a lease default by the tenant and all deposits are forfeited to the landlord.
